Q: I was pulled over in Kansas and the cops arrested me for DUI. I just work part-time and do not have much money. I know I need a lawyer but I can't afford to pay one. I just found out that I already missed the deadline to contest my license being suspended. How can I get a lawyer to help me?
A: I am sorry to hear that you are having problems. This kind of thing happens every day. When you are charged with a DUI you really need to hire a criminal defense attorney to advocate on your behalf. That being said, I know that attorney fees can be expensive defending a DUI case. If you can't afford an attorney you need to go to the court and let them know that you do not have funds available to hire a DUI defense attorney for your case. I would go in and ask the court clerk for a pauper's affidavit and tell them you would like an attorney appointed to your case. A pauper's affidavit is basically a document that lets the court know that you need help defending yourself. (Not every jurisdiction will call it the same thing, just explain to the court clerk your problem and they will usually help) The court will review the affidavit and determine if you qualify for an appointed attorney, if you do then the court will appoint you a lawyer that is paid for by the court. If they do not then you need to start talking to private lawyers to see if any will help, or at least take payments for their attorney's fees. Remember a DUI is a serious charge that can easily land you in jail, don't wait around until right before your court date. Get out and start addressing this problem right away. Good luck.
